Terms of Service

Use Character App responsibly.

Character App is a creative product for adults. These Terms tell you what you can expect from us, what we expect from you, and what happens if something goes wrong.

Last updated September 19, 2026

17+ only

You must be 17 or older, legally able to enter a contract, and not located in a US-sanctioned country.

You own your outputs

Subject to provider terms, you own what you generate. You grant us a limited license only to host and display it so we can run the product.

Consent-first

No depicting real people without their consent. No CSAM. No non-consensual intimate imagery. See the Content Policy.

1. Acceptance of These Terms

These Terms of Service ("Terms") are a legal agreement between you and charactr, inc. ("charactr," "we," "us") governing your access to and use of the Character App apps, websites, APIs, and related services (the "Service").

By creating an account, submitting a prompt, subscribing to a plan, tapping "I Agree" on the age gate, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, Content Policy, and EULA. If you don't agree, don't use the Service.

1.1 iOS Users — Apple EULA. If you use Character App on iOS, you also agree to our End User License Agreement, which contains the terms required by Apple's "Licensed Application End User License Agreement" template. In particular, you acknowledge that (a) this agreement is between you and charactr, inc. only, not Apple; (b) charactr, inc., not Apple, is solely responsible for the app and its content; (c) Apple has no obligation to provide any maintenance or support for the app; (d) in the event the app fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any); beyond that, Apple has no warranty obligations and any other claims, losses, or expenses are charactr, inc.'s sole responsibility; (e) charactr, inc. is responsible for any product, IP, or consumer-protection claims; and (f) Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and the EULA, with the right to enforce them against you.

2. Eligibility and Age

You may use Character App only if all of the following are true:

  • you are at least 17 years old;
  • you are legally capable of entering into a binding contract where you live;
  • you are not located in, or a national of, a country subject to comprehensive US sanctions (currently Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine);
  • you are not on any US government restricted-party list;
  • you have not been previously banned from the Service;
  • you will comply with all applicable laws, regulations, and platform policies (including App Store policies on iOS).

On first launch we present a date-of-birth age gate. If you enter an age under 17, access is denied.

3. The Service

Character App is an AI-powered creative studio for designing characters, generating images and videos, building storyboards, and producing related content using third-party AI providers (including OpenAI, Google Imagen, and Seedance).

The Service is provided on an "as-is" and "as-available" basis. Features, models, pricing, and providers may change. We may modify or discontinue parts of the Service at any time with reasonable notice.

4. Your Account

You are responsible for:

  • providing accurate information when you sign up;
  • keeping your credentials (email, password, Apple ID, Google account, passkey) secure;
  • everything that happens under your account, including all generations, purchases, and uploads;
  • one account per person — no sharing, no multiple accounts to evade limits or enforcement.

If you suspect unauthorized use, contact support@character.app immediately.

5. Your Inputs and Your Outputs

Inputs. Prompts, reference images, character definitions, scene descriptions, and anything else you provide to the Service are your "Inputs." You keep any rights you have in your Inputs. You grant us a worldwide, royalty-free license to host, store, transmit, process, and display your Inputs solely to deliver the Service to you.

Outputs. Images, videos, characters, storyboards, and other content the Service generates for you are your "Outputs." Subject to each provider's terms, you own your Outputs and may use them for personal or commercial purposes within the bounds of these Terms and applicable law.

  • OpenAI's Standard tier retains no rights to customer outputs.
  • Google Imagen and ByteDance Seedance similarly treat customer outputs as belonging to the customer.
  • Because AI outputs are probabilistic, identical or substantially similar outputs may be generated for other users. We do not guarantee exclusivity.

You grant us a limited, non-exclusive license to host and display your Outputs solely to deliver the Service. We do not use your Outputs to train AI models.

6. Reference Uploads

When you upload a reference image or short video, you represent and warrant that:

  • you own the content or have all necessary rights and consents to upload and use it;
  • you have consent from any identifiable real person depicted (and, for minors, from their parent or guardian — though we note that uploading images of minors for character generation is prohibited regardless);
  • the content does not infringe any copyright, trademark, right of publicity, privacy right, or contractual obligation;
  • the content does not violate our Content Policy.

7. Prohibited Uses

Our Content Policy describes what you can and can't generate. The short version: no CSAM (including AI-generated), no non-consensual intimate imagery, no content sexualizing minors, no identifiable real people without consent, no content targeting protected classes with violence or incitement, no malware, no illegal goods.

You also may not:

  • reverse engineer, decompile, or disassemble the Service;
  • scrape, crawl, or mass-extract content or outputs;
  • circumvent rate limits, entitlement checks, or moderation systems;
  • resell, sublicense, or white-label the Service;
  • use the Service to build a competing product or train a competing model;
  • use the Service in any safety-critical context (medical, legal, financial, employment, etc.);
  • depict any identifiable real person (including public figures, celebrities, politicians, co-workers, ex-partners, or anyone else) without that person's explicit consent, or create deepfakes, fabricated endorsements, or misleading political content.

7.1 Reporting abuse. If you encounter content on Character App that you believe violates these Terms, our Content Policy, or your rights, report it from inside the app (long-press an output > Report) or email support@character.app. Reports involving CSAM are escalated to the National Center for Missing & Exploited Children (NCMEC) where required by law. Reports involving non-consensual intimate imagery are reviewed within 24 hours.

8. Intellectual Property

Character App, our logos, trade dress, and the software, design, and models that power the Service are owned by charactr, inc. or our licensors. Nothing in these Terms transfers ownership of that IP to you.

You may not use our name, logo, or branding to suggest sponsorship or endorsement without our written permission.

9. Subscriptions, Billing, and Refunds

iOS (Apple IAP). Subscriptions purchased on iOS are processed by Apple via StoreKit 2 (wrapped by RevenueCat). Billing, renewal, and cancellation are managed in your Apple ID settings. Refunds are governed by Apple's policies.

Web (Stripe). Subscriptions purchased on the web are processed by Stripe. You can cancel anytime in Account > Subscription; cancellation takes effect at the end of the current billing cycle.

Subscriptions auto-renew at the then-current price until you cancel. We will notify you before any price change for an existing subscription.

Except where required by law (e.g. EU 14-day withdrawal right for services not yet consumed), fees are non-refundable. Credits issued as part of a subscription do not carry value outside the Service and cannot be redeemed for cash. Unused plan Credits expire at the end of the paid period and do not roll over. Refunds or chargebacks may reverse associated Credits.

Credits and consumables. Plan and separately purchased top-up Credits appear in one wallet balance. Unused plan Credits do not roll over. Top-up credits expire 3 months after purchase. Only purchased top-ups carry over; this includes existing top-ups. Credit packs are non-refundable except where required by law. Refunds or chargebacks may reverse associated Credits. Daily free Images are not Credits: they reset each UTC day and do not roll over. Credits are not transferable, have no cash value, and cannot be redeemed outside the Service. An active subscription is required for Clips and Film.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, AND QUIET ENJOYMENT.

AI outputs may be inaccurate, offensive, biased, or hallucinated. You must review Outputs before using them publicly, commercially, or in any sensitive context. We do not warrant uptime, model availability, or any specific creative result.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHARACTR, INC., ITS AFFILIATES, AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE.

OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions don't allow these limitations. In that case, the limitations apply only to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless charactr, inc., its affiliates, and their respective employees, contractors, agents, officers, and directors from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to:

  • your Inputs or Outputs;
  • your reference uploads;
  • your violation of these Terms, the Content Policy, or applicable law;
  • your violation of any third-party right, including rights of publicity, privacy, and intellectual property.

13. DMCA and Copyright

We respond to valid DMCA notices and counter-notices. See our DMCA Policy for instructions and our designated agent contact information.

14. Suspension and Termination

You can stop using the Service anytime and start account deletion from Account > Delete Account. Work that belongs only to you is deleted; shared contributions may remain with your identity removed. If you own an active collaborative World, you must archive or transfer it before deletion can complete, as described in our Privacy Policy § 6.

We may suspend or terminate your access immediately and without notice if we believe you violated these Terms, the Content Policy, or applicable law, or if your use creates risk for other users or the Service. On termination, your right to use the Service ends. Sections that should survive (billing, IP, disclaimers, liability, indemnity, dispute resolution) will survive.

Content removal. Independent of any account action, we may remove or restrict access to any content (Inputs, Outputs, or reference uploads) that we determine in good faith violates these Terms, the Content Policy, applicable law, or platform policies, or that poses a risk to other users or the Service. Where practical, we will notify you, but we may act without prior notice for safety, legal, or platform-compliance reasons.

Inactive accounts. If your account has had no sign-in activity for 24 consecutive months, we may, after sending an email notice to the address on file at least 30 days in advance, delete your account and associated data. We will not delete an account with an active paid subscription without first canceling it.

15. Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

Any dispute between you and charactr, inc. arising out of or related to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer or Commercial Arbitration Rules, as applicable. The arbitration will be held in Delaware or, at your election, a location reasonably convenient to you.

Class action waiver. You and we each agree that any dispute will be brought only in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

30-day opt-out. You may opt out of this arbitration agreement by emailing support@character.app within 30 days of first accepting these Terms. Your opt-out notice must include your name, account email, and a clear statement that you are opting out.

Small-claims court actions and intellectual property injunctive relief are excluded from this arbitration requirement.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply.

If the arbitration clause above does not apply to you (for example, you opted out or your jurisdiction bars it), the state and federal courts located in Delaware have exclusive jurisdiction.

17. Export Controls

You may not use, export, or re-export the Service in violation of US export control laws or regulations, including the Export Administration Regulations and OFAC sanctions. You represent that you are not located in, or a national of, a sanctioned country, and not on any restricted-party list.

18. General Terms

Entire agreement. These Terms, the Privacy Policy, the Content Policy, the EULA, the DMCA Policy, and the Cookie Policy are the entire agreement between you and us.

Severability. If any provision is unenforceable, the remaining provisions stay in effect.

No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.

Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.

Notices. We send notices via email and in-app. You send notices to support@character.app.

Force majeure. Neither party will be liable for failure or delay in performance caused by events beyond reasonable control (including provider outages, internet failures, natural disasters, government action, or labor disputes). Affected obligations are suspended for the duration of the event.

19. Changes and Contact

We may update these Terms from time to time. For material changes we will notify you in-app and by email before the change takes effect. Your continued use of the Service after that means you accept the updated Terms.
